Purpose of this notice is to inform you, as a user of our ShapCommunity.co.za tool, of your rights and how the information you submit will be used in accordance with the Protection of Personal Information Act No. 4 of 2013 ("POPIA").
The purpose of the ShapCommunity.co.za tool is to provide you with a fast, accessible tool to immediately report improperly discarded used needles and syringes in public spaces, fuelling our vision of a safe, clean, and empowered community.

A data subject as defined by POPIA, is a person to whom personal information relates.
Personal information as defined by POPIA, is any information relating to an identifiable, living, natural person and where it is applicable an identifiable existing juristic person.
Examples of personal information include name, surname, contact details, identity number, location data, gender, age, online identifier, personal opinions, views or preferences of a data subject.
3. Who are we
TB HIV Care (THC) NPC, with registration number 15/122776/08, with its principal place of business at 7th Floor, 11 Adderley Street, Cape Town, 8001, is a registered non-profit organisation responding to TB, HIV, and other major diseases through working to prevent, find and treat TB and HIV in South Africa.

4. What Personal Information is Collected
We will collect and process the following personal information from you: name, email address, cell phone number, your view/ opinion.
This information is collected directly from you.
5. Purpose of Collection
The personal information is collected in order to:
- notify us that injecting equipment has been improperly discarded which is mandatory in order for us to achieve our purpose, and
- provide you with feedback on the status of the report if you so wish.
The lawful basis under which we process your personal information may be consent, legal obligation, and legitimate interest.
6. Use and Processing of Personal Information
Your personal information will be used to enable us to safely remove improperly discarded injecting equipment (needles and syringes).
There will be no automated decision-making or profiling involved.
7. Disclosure of Information
Your personal information may be shared with:
- our third-party service provider in order to facilitate tool development, implementation, hosting and support in accordance with an agreement entered into between us and the third-party service provider, and
- information regulator, if necessary.
8. Storage and Retention
All collected data is stored securely on encrypted servers located in South Africa, with access restricted to authorized personnel only.
Personal data will be retained for a period of 5 years from date of collection, after which it will be securely anonymized or destroyed in accordance with POPIA regulations.
Data disposal follows secure deletion protocols including cryptographic erasure for digital records and cross-shredding for physical documents.

9. Security Measures
The main risk of us processing your personal information is if it is lost, stolen or misused. This could lead to your personal information being in the hands of someone else who may use it fraudulently or make public information that you would prefer to keep private. For this reason, THC is committed to protecting personal data from loss, misuse, disclosure, alteration, unauthorised access, unavailability and destruction and takes all reasonable precautions to safeguard the confidentiality of personal data, including through use of appropriate organisational and technical measures.

Lodge a complaint with the Information Regulator.
